The EB-3 visa has three subcategories:

  1. Skilled Workers: This subcategory is for foreign workers who have at least two years of job experience or training in a skilled profession, and a job offer from a U.S. employer that requires such skills.
  2. Professionals: This subcategory is for foreign workers who have a U.S. bachelor’s degree or equivalent degree from a foreign country, and a job offer from a U.S. employer that requires such a degree.
  3. Other Workers: This subcategory is for foreign workers who perform unskilled labor, such as farm labor or custodial work, and have a job offer from a U.S. employer.

EB-3 visa applicants must have a labor certification approved by the U.S. Department of Labor, which confirms that there are no qualified U.S. workers available for the job that the foreign worker will fill. Additionally, the U.S. employer must file an I-140 petition on behalf of the foreign worker. Once the petition is approved, the foreign worker can apply for permanent residency through consular processing or adjustment of status.
